Terms of Service

1. Account Requirements

You must be at least 13 years old to use Noble Ambience. By creating an account, you represent that you meet this age requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Noble Ambience offers a guest mode that does not require account creation. Guest data is stored locally on your device and is not synced across devices. Creating an account enables cloud sync, cross-device access, and data backup.

2. Subscription Terms

Noble Ambience offers free and premium tiers. Premium subscriptions are available on a monthly or annual basis.

  • Billing — subscriptions are billed in advance on a recurring basis through your device's app store (Apple App Store or Google Play) or through our authorized web payment processor
  • Free trials — if offered, your subscription begins at the end of the trial period unless you cancel before it ends
  • Cancellation — you may cancel your subscription at any time. Access to premium features continues until the end of your current billing period. Cancellation does not entitle you to a refund for the current period
  • Price changes — we may change subscription prices with reasonable notice. Price changes take effect at the start of the next billing period following the notice

3. Content & Ownership

  • Your content — you retain ownership of mixes, recordings, and other content you create. By using Noble Ambience, you grant us a limited license to store and sync your content for service delivery
  • Our content — all sounds, music, artwork, and other materials provided by Noble Ambience are owned by Noble Achievements LLC or licensed to us. You may use these materials only within the app for personal, non-commercial purposes
  • AI-generated content — mixes created by the AI Mix Creator use our existing sound library. You may save and use these mixes under the same terms as manually created mixes

4. Content Restrictions

When uploading custom recordings or audio files, you agree not to upload content that:

  • Infringes on intellectual property rights of others
  • Contains harmful, offensive, or illegal material
  • Contains malware or malicious code
  • Violates any applicable laws or regulations

We reserve the right to remove content that violates these restrictions.

5. Prohibited Activities

You agree not to:

  • Reverse engineer, decompile, or disassemble the app
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the app for any commercial purpose without our written permission
  • Redistribute, resell, or sublicense access to the app or its content
  • Use automated systems to scrape, extract, or download content from the app
  • Interfere with or disrupt the app's functionality or servers

6. Limitation of Liability

To the maximum extent permitted by law, Noble Achievements LLC's total liability to you for any claims arising from your use of Noble Ambience shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the app.

7. Dispute Resolution

Any disputes arising from these Terms or your use of Noble Ambience shall be resolved through binding arbitration administered by a recognized arbitration association, rather than in court, except for claims that qualify for small claims court.

  • Arbitration opt-out — you may opt out of arbitration by sending written notice to contact@nobleachievements.com within 30 days of first agreeing to these Terms
  • Class action waiver — you agree to resolve disputes individually and not as part of a class, consolidated, or representative action
  • Governing law — these Terms are governed by the laws of the state where Noble Achievements LLC is incorporated

8. EU Consumer Rights

If you are a consumer in the European Union, nothing in these Terms affects your statutory consumer rights under applicable EU law, including the right to a 14-day withdrawal period for digital content purchases. Mandatory consumer protection laws of your country of residence apply regardless of the governing law provision above.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of Noble Ambience after changes take effect constitutes acceptance of the updated Terms. If you disagree with any changes, you may stop using the app and delete your account.
